Overview

These Terms of Service govern your use of the Frossen website (frossen.com.au) and any transactions you enter into with us, including joining our waitlist or placing a deposit.

By using our website or placing a deposit, you agree to these terms. If you don't agree, please don't use the site or make a purchase.

Frossen is an Australian business currently in the product development phase. We are building the FROSSEN F1 cold plunge and this website exists to validate demand before committing to full production.

Waitlist

Joining the free waitlist involves providing your name, email, and some optional details about your intended use. By joining, you agree to receive product updates and communications from us.

You can unsubscribe from our emails at any time using the unsubscribe link in any email we send, or by contacting us directly at support@frossen.com.au.

Joining the waitlist does not reserve a product, guarantee availability, or create any obligation to purchase.

Deposit Terms

Placing a $299 deposit reserves your place in the first production batch of 10 units. It is not a purchase — no product will be shipped until production is confirmed and a separate purchase agreement is made.

By placing a deposit, you acknowledge:

  • The FROSSEN F1 is currently in development and has not entered mass production
  • The $299 deposit is fully refundable at any time, for any reason, on request
  • First batch deposit holders are locked in at $4,999 AUD. This price is guaranteed upon proceeding to purchase.
  • If we proceed to production, deposit holders will be contacted to confirm their purchase and pay the balance
  • You are under no obligation to proceed with a purchase even if production is confirmed
  • Deposits are processed securely by Stripe

Refund Policy

Deposits are fully refundable at any time, no questions asked.

To request a refund, email us at support@frossen.com.au with your name and the email address used at checkout. We will process your refund within 2 business days.

Refunds are returned to the original payment method via Stripe and typically appear within 5–10 business days, depending on your bank.

If we decide not to proceed with production, all deposits will be refunded automatically without you needing to request one.

No Guarantee of Production

Frossen is a pre-launch business. While we intend to produce and deliver the FROSSEN F1, we cannot guarantee that we will do so. Circumstances may prevent us from proceeding, including but not limited to:

  • Insufficient demand to justify production
  • Supplier or manufacturing issues
  • Regulatory or compliance requirements
  • Changes in business circumstances

If we are unable to proceed for any reason, all deposits will be refunded in full. We will not proceed with production unless we are confident in our ability to deliver.

We commit to communicating honestly with deposit holders and waitlist members about our progress, including setbacks.

Website Use

You may use our website for lawful purposes only. You must not use the site in any way that causes or may cause damage to the site or impairment of its availability.

All content on this website — including text, images, and product designs — is owned by or licensed to Frossen. You may not reproduce or use our content without written permission.

Product images on this website are concept renders and may not exactly represent the final product.

Limitation of Liability

To the extent permitted by Australian law, Frossen's liability to you in connection with your use of this website or any deposit placed is limited to the amount of the deposit paid.

We are not liable for any indirect, incidental, or consequential loss arising from your use of the website or reliance on information contained on it.

Nothing in these terms limits your rights under the Australian Consumer Law.

Changes to These Terms

We may update these terms from time to time. When we do, we will update the "last updated" date at the top of this page. If changes are material, we will notify deposit holders by email.

Continued use of the website after changes constitutes acceptance of the updated terms.

These terms are governed by the laws of Victoria, Australia.
